Le premier avis de cette s\u00e9rie, adopt\u00e9 par l\u2019Assembl\u00e9e pl\u00e9ni\u00e8re le 20 janvier 2020, faisait une description globale du ph\u00e9nom\u00e8ne du travail transfrontalier afin de mettre en avant l\u2019importance vitale de cet apport en main- d\u2019\u0153uvre pour l\u2019\u00e9conomie luxembourgeoise.<\/p>\n<div class=\"page\" title=\"Page 3\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p>Au Luxembourg, le r\u00e9gime de t\u00e9l\u00e9travail fait l\u2019objet d\u2019un encadrement juridique \u00e0 travers une convention- cadre sign\u00e9e le 21 f\u00e9vrier 2006 entre l\u2019Union des Entreprises Luxembourgeoises (UEL) d\u2019une part et les syndicats OGBL et LCGB d\u2019autre part. Cette convention-cadre a \u00e9t\u00e9 reconduite \u00e0 deux reprises (en 2011 et en 2015) et d\u00e9clar\u00e9e d\u2019obligation g\u00e9n\u00e9rale le 15 mars 2016 par voie de r\u00e8glement grand-ducal.<\/p>\n<p>Le pr\u00e9sent avis du CES entend pourtant d\u00e9passer les d\u00e9bats publics qui simplifient souvent exag\u00e9r\u00e9ment une mati\u00e8re dont le d\u00e9tail est assez complexe. Il s\u2019inscrit ainsi dans l\u2019actualit\u00e9, mais entend pr\u00e9senter de mani\u00e8re objective les diff\u00e9rents aspects du t\u00e9l\u00e9travail, ses nombreuses implications l\u00e9gales, fiscales, de s\u00e9curit\u00e9 sociale, \u00e9conomiques, soci\u00e9tales, budg\u00e9taires ainsi que des pistes de r\u00e9flexion et recommandations en vue d\u2019adapter le cadre existant.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"page\" title=\"Page 4\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p>Il commence, dans un premier chapitre, par une pr\u00e9sentation des diff\u00e9rents concepts du t\u00e9l\u00e9travail et par un bref historique de son \u00e9volution depuis les ann\u00e9es 1970 jusqu\u2019\u00e0 aujourd\u2019hui.<\/p>\n<p>Ensuite, dans un deuxi\u00e8me chapitre, il se focalise sur les donn\u00e9es statistiques en pr\u00e9sentant la situation au Luxembourg d\u2019abord en 2019, ensuite en avril 2020, c\u2019est-\u00e0-dire pendant le confinement, pour montrer l\u2019impact de la crise sanitaire sur le r\u00e9gime du t\u00e9l\u00e9travail.<\/p>\n<p>Le chapitre trois est d\u2019abord d\u00e9di\u00e9 aux risques et aux opportunit\u00e9s du t\u00e9l\u00e9travail pour le salari\u00e9 ainsi que pour l\u2019employeur pour ensuite pr\u00e9senter d\u2019une mani\u00e8re plus g\u00e9n\u00e9rale les d\u00e9fis du t\u00e9l\u00e9travail en tenant compte des r\u00e9percussions soci\u00e9tales et sur le d\u00e9veloppement durable. Au-del\u00e0, il met en avant les \u00e9ventuelles implications que pourraient avoir un accroissement du nombre de t\u00e9l\u00e9travailleurs notamment sur le budget de l\u2019\u00c9tat ou sur l\u2019\u00e9conomie luxembourgeoise.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"page\" title=\"Page 5\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p>Enfin, le dernier chapitre constitue la pi\u00e8ce ma\u00eetresse de cet avis car il porte sur le cadre l\u00e9gislatif et r\u00e9glementaire existant et formule des recommandations concr\u00e8tes au sujet des divers aspects que comprend le r\u00e9gime du t\u00e9l\u00e9travail, sur base notamment de quelques exemples de l\u00e9gislations
