S\u2019appliquant \u00e0 l\u2019ensemble des entreprises impact\u00e9es par la pand\u00e9mie pendant cette p\u00e9riode de relance \u00e9conomique, ces modalit\u00e9s tiennent n\u00e9anmoins compte du fait que certains secteurs ou branches \u00e9conomiques sont plus s\u00e9v\u00e8rement impact\u00e9s que d\u2019autres.<\/p>\n<p>Les modalit\u00e9s d\u2019application pour les 6 premiers mois de 2021 sont d\u00e9finies en <strong>2 p\u00e9riodes distinctes<\/strong> :<\/p>\n<ol>\n<li>du <strong>1<sup>er<\/sup> janvier au 30 avril 2021<\/strong> ; et<\/li>\n<li>du <strong>1<sup>er<\/sup> mai 2021 au 30 juin 2021<\/strong>.<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<h4 id=\"bloub-2\">ORGANISATIONS \/ ENTREPRISES CONCERN\u00c9ES POUR LE CH\u00d4MAGE PARTIEL JUSQU&rsquo;AU 30 AVRIL<\/h4>\n<p>Les partenaires sociaux se sont mis d\u2019accord sur <strong>4 cas de figures<\/strong> possibles pour que les entreprises puissent b\u00e9n\u00e9ficier du r\u00e9gime de ch\u00f4mage partiel pendant la p\u00e9riode de relance \u00e9conomique :<\/p>\n<ol>\n<li>les <strong>entreprises industrielles<\/strong> continuent \u00e0 b\u00e9n\u00e9ficier du r\u00e9gime de ch\u00f4mage partiel conjoncturel afin de pouvoir r\u00e9agir face aux perturbations des march\u00e9s internationaux (par exemple, des probl\u00e8mes d\u2019approvisionnement).<br \/>\nEn appliquant le r\u00e9gime du ch\u00f4mage partiel de source conjoncturelle, les entreprises industrielles s&rsquo;engagent \u00e0 ne pas proc\u00e9der \u00e0 des licenciements pour motif \u00e9conomique ;<\/li>\n<li>les <strong>entreprises des secteurs vuln\u00e9rables de l&rsquo;horeca, du tourisme ainsi que du secteur \u00e9v\u00e8nementiel<\/strong> b\u00e9n\u00e9ficient d&rsquo;un acc\u00e8s acc\u00e9l\u00e9r\u00e9 au ch\u00f4mage partiel de source structurelle, sans limitation du nombre de salari\u00e9s concern\u00e9s.<br \/>\nEn cas de besoin av\u00e9r\u00e9, ces entreprises peuvent recourir \u00e0 des <a title=\"Licenciement avec pr\u00e9avis\" href=\"https:\/\/guichet.public.lu\/fr\/entreprises\/ressources-humaines\/fin-relation-travail\/licenciement-resiliation\/licencier-preavis.html\">licenciements pour motifs \u00e9conomiques<\/a> dans la <strong>limite maximale de 25 % de leurs salari\u00e9s<\/strong> (par rapport \u00e0 l\u2019effectif total recens\u00e9 au 30 juin 2020) jusqu&rsquo;au 30 avril 2021. Il a \u00e9t\u00e9 convenu entre partenaires sociaux qu&rsquo;en cas de retour \u00e0 meilleure fortune, les entreprises qui ont ainsi proc\u00e9d\u00e9 \u00e0 des licenciements devront, en cas de recrutement ult\u00e9rieur de personnel, r\u00e9embaucher en priorit\u00e9 leurs anciens salari\u00e9s licenci\u00e9s.<br \/>\n\u00c0 noter que les dispositions de droit commun pr\u00e9vues par le Code du travail qui concernent notamment le <a href=\"https:\/\/guichet.public.lu\/fr\/entreprises\/ressources-humaines\/fin-relation-travail\/licenciement-resiliation\/licenciement-collectif.html\">licenciement collectif<\/a>restent enti\u00e8rement applicables ;<\/li>\n<li>les <strong>entreprises touch\u00e9es par la crise sanitaire autres que les entreprises industrielles et celles qui rel\u00e8vent des secteurs vuln\u00e9rables<\/strong> peuvent \u00e9galement recourir au ch\u00f4mage partiel de source structurelle par la voie acc\u00e9l\u00e9r\u00e9e <strong>\u00e0 condition<\/strong> toutefois de ne <strong>pas proc\u00e9der \u00e0 des licenciements<\/strong>. Dans ce cas, le <strong>nombre d\u2019heures de travail perdues ne peut pas d\u00e9passer 15 % du total des heures de travail mensuelles normales de l\u2019entreprise<\/strong>. Les heures de travail normales ne peuvent pas exc\u00e9der 40 heures par semaine et par salari\u00e9 ;<\/li>\n<li>les <strong>entreprises<\/strong> :<\/li>\n<\/ol>\n<ul>\n<li><strong>des secteurs vuln\u00e9rables (horeca, tourisme, \u00e9v\u00e9nementiel)<\/strong> qui licencient plus de 25 % de leur effectif total (recens\u00e9 au 30 juin 2020) ;<\/li>\n<li><strong>relevant des autres secteurs touch\u00e9s par la crise<\/strong> qui devraient n\u00e9anmoins proc\u00e9der \u00e0 des licenciements ou dont le nombre d\u2019heures de travail perdues devrait d\u00e9passer 15 % du total des heures de travail mensuelles normales de l\u2019entreprise ;ne peuvent le faire qu\u2019\u00e0 conditionque ces entreprises fournissent :<\/li>\n<li>un <a href=\"https:\/\/guichet.public.lu\/fr\/entreprises\/sauvegarde-cessation-activite\/sauvegarde-emploi\/plan-maintien-emploi\/plan-redressement.html\">plan de redressement<\/a>, pour les petites entreprises de moins de 15 personnes ; <strong>ou<\/strong><\/li>\n<li>un\u00a0<a href=\"https:\/\/guichet.public.lu\/fr\/entreprises\/sauvegarde-cessation-activite\/sauvegarde-emploi\/plan-maintien-emploi\/negocier.html\">plan de maintien dans l&#8217;emploi<\/a>, le cas \u00e9ch\u00e9ant sectoriel, conforme aux dispositions des articles L.513-1 et suivants du Code du travail, pour les entreprises qui occupent plus de 15 salari\u00e9s.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong>ORGANISATIONS \/ ENTREPRISES CONCERN\u00c9ES POUR LE CH\u00d4MAGE PARTIEL \u00c0 PARTIR DU 1ER MAI<\/strong><\/p>\n<p>Les partenaires sociaux se sont mis d\u2019accord sur <strong>4 cas de figure<\/strong> possibles pour que les entreprises puissent b\u00e9n\u00e9ficier du r\u00e9gime de ch\u00f4mage partiel pendant la p\u00e9riode de relance \u00e9conomique :<\/p>\n<ol>\n<li>les <strong>entreprises industrielles<\/strong> continuent \u00e0 b\u00e9n\u00e9ficier du r\u00e9gime de ch\u00f4mage partiel conjoncturel afin de pouvoir r\u00e9agir face aux perturbations des march\u00e9s internationaux (par exemple, des probl\u00e8mes d\u2019approvisionnement).<br \/>\nEn appliquant le r\u00e9gime du ch\u00f4mage partiel de source conjoncturelle, les entreprises industrielles s&rsquo;engagent \u00e0 ne pas proc\u00e9der \u00e0 des licenciements pour motif \u00e9conomique ;<\/li>\n<li>les <strong>entreprises des secteurs de l&rsquo;horeca, du tourisme ainsi que du secteur \u00e9v\u00e8nementiel<\/strong> b\u00e9n\u00e9ficient d&rsquo;un acc\u00e8s acc\u00e9l\u00e9r\u00e9 au ch\u00f4mage partiel de source structurelle dans la limite maximale de 50 % du total des heures de travail mensuelles normales, \u00e0 <strong>condition<\/strong> de ne pas proc\u00e9der \u00e0 des licenciements pour des raisons non-inh\u00e9rentes \u00e0 la personne.<br \/>\nLes heures de travail normales ne peuvent pas d\u00e9passer 40 heures par semaine et par salari\u00e9.<br \/>\nAu cas o\u00f9 ces entreprises seraient \u00e0 nouveau contraintes de fermer leurs portes suite \u00e0 une d\u00e9cision administrative, elles b\u00e9n\u00e9ficieraient \u00e0 nouveau du ch\u00f4mage partiel illimit\u00e9 pendant la p\u00e9riode de fermeture ;<\/li>\n<li>les <strong>entreprises touch\u00e9es par la crise sanitaire, autres que les entreprises industrielles et celles qui rel\u00e8vent des secteurs de l\u2019horeca, du tourisme et de l\u2019\u00e9v\u00e8nementiel,<\/strong> peuvent \u00e9galement recourir au ch\u00f4mage partiel de source structurelle par la voie acc\u00e9l\u00e9r\u00e9e <strong>\u00e0 condition<\/strong> toutefois de ne <strong>pas proc\u00e9der \u00e0 des licenciements<\/strong>.<br \/>\nDans ce cas, le <strong>nombre d\u2019heures de travail perdues ne peut pas d\u00e9passer 10 % du total des heures de travail mensuelles normales de l\u2019entreprise<\/strong>. Les heures de travail normales ne peuvent pas exc\u00e9der 40 heures par semaine et par salari\u00e9 ;<\/li>\n<li>\n<ul>\n<li>un <a href=\"https:\/\/guichet.public.lu\/fr\/entreprises\/sauvegarde-cessation-activite\/sauvegarde-emploi\/plan-maintien-emploi\/plan-redressement.html\">plan de redressement<\/a>, pour les petites entreprises de moins de 15 personnes ; <strong>ou<\/strong><\/li>\n<li>un <a href=\"https:\/\/guichet.public.lu\/fr\/entreprises\/sauvegarde-cessation-activite\/sauvegarde-emploi\/plan-maintien-emploi\/negocier.html\">plan de maintien dans l&#8217;emploi<\/a>, le cas travail perdues devrait d\u00e9passer 10 % du total des heures de travail mensuelles normales de l\u2019entreprise ;<\/li>\n<\/ul>\n<p><strong>ne peuvent le faire qu\u2019\u00e0 condition<\/strong>
