D\u2019exception, le t\u00e9l\u00e9travail est devenu la r\u00e8gle pour un grand nombre de travailleurs et a permis ainsi de sauver l\u2019\u00e9conomie d\u2019un effondrement plus marqu\u00e9 encore.<\/p>\n<p>Dans ce contexte, il \u00e9tait urgent d\u2019en moderniser le cadre l\u00e9gal qui restait inchang\u00e9 \u2013 malgr\u00e9 la digitalisation sans cesse croissante au sein des entreprises \u2013 depuis la signature de la convention nationale relative au t\u00e9l\u00e9travail de 2006 reconduite \u00e0 plusieurs reprises.<\/p>\n<p>Les partenaires sociaux ont retenu, de concert avec le Ministre du Travail, de l\u2019Emploi et de l\u2019\u00c9conomie sociale et solidaire, d\u2019en discuter au sein du Conseil \u00e9conomique et social (ci-apr\u00e8s \u00ab CES \u00bb). Le CES a ainsi adopt\u00e9 le 11 septembre un avis commun en mati\u00e8re de t\u00e9l\u00e9travail, comprenant une nouvelle proposition de convention.<\/p>\n<p>Dans la continuit\u00e9 des travaux du CES, le LCGB, l\u2019OGBL et l\u2019UEL ont sign\u00e9 ce 20 octobre un nouvel accord interprofessionnel relatif au t\u00e9l\u00e9travail. Si cette nouvelle convention maintient le caract\u00e8re volontaire du t\u00e9l\u00e9travail dans le chef du salari\u00e9 et de l\u2019employeur, point fondamental tant pour les syndicats que pour le patronat, elle innove sur diff\u00e9rents aspects.<\/p>\n<p>La d\u00e9finition du t\u00e9l\u00e9travail est \u00e9court\u00e9e et le champ d\u2019application est pr\u00e9cis\u00e9 gr\u00e2ce \u00e0 des exclusions explicites. La convention r\u00e9glera d\u00e9sormais tant le t\u00e9l\u00e9travail r\u00e9gulier \u2013 \u00e0 l\u2019instar de la convention actuelle \u2013 que le t\u00e9l\u00e9travail occasionnel et clarifie ces notions par la fixation d\u2019un seuil pour contrer l\u2019incertitude juridique actuelle \u00e0 ce niveau.<\/p>\n<p>La convention modernise par ailleurs les voies disponibles pour introduire le t\u00e9l\u00e9travail au sein des entreprises et pr\u00e9cise le r\u00f4le des repr\u00e9sentants du personnel dans ce contexte. Elle pr\u00e9voit aussi les droits et obligations \u00e0 charge des parties en mati\u00e8re de protection des donn\u00e9es, d\u2019\u00e9quipement de travail, de sant\u00e9 et de s\u00e9curit\u00e9, d\u2019organisation du travail et de formation. Le principe de non-discrimination entre les t\u00e9l\u00e9travailleurs et les autres travailleurs a \u00e9t\u00e9 mis en \u00e9vidence par l\u2019introduction d\u2019une disposition sp\u00e9cifique sur l\u2019\u00e9galit\u00e9 de traitement.<\/p>\n<p>Cette nouvelle convention sign\u00e9e s\u2019inscrit dans la dur\u00e9e. Si elle a pu b\u00e9n\u00e9ficier des apprentissages du t\u00e9l\u00e9travail massivement effectu\u00e9 pendant la crise actuelle, elle n\u2019a pour autant pas vocation \u00e0 r\u00e9gler le t\u00e9l\u00e9travail mis en place par les entreprises pour r\u00e9pondre \u00e0 cette situation exceptionnelle qui perturbe encore gravement leur fonctionnement. Les entreprises seront cependant bien avis\u00e9es de clarifier par \u00e9crit avec les salari\u00e9s concern\u00e9s les modalit\u00e9s de ce r\u00e9gime temporaire de t\u00e9l\u00e9travail.<\/p>\n<p>La nouvelle convention relative au t\u00e9l\u00e9travail devrait entrer prochainement en vigueur pour l\u2019ensemble des entreprises au Luxembourg suite \u00e0 sa d\u00e9claration d\u2019obligation g\u00e9n\u00e9rale par voie de r\u00e8glement grand-ducal, suivant la demande des partenaires sociaux adress\u00e9e en ce sens au Ministre du Travail, de l\u2019Emploi et de l\u2019\u00c9conomie sociale et solidaire.
