Et ce pour son seul co\u00fbt direct en mati\u00e8re de continuation des salaires (donc hors co\u00fbt de remplacement du personnel, personnel int\u00e9rim, co\u00fbts de gestion, p\u00e9nalit\u00e9s de retards, insatisfaction accrue des salari\u00e9s pr\u00e9sents, etc.).<\/span><i><span data-contrast=\"auto\">\u00a0<\/span><\/i><span data-ccp-props=\"{&quot;335551550&quot;:6,&quot;335551620&quot;:6}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">S\u2019il est tout \u00e0 fait \u00e9vident que tout un chacun peut et a le droit d\u2019\u00eatre malade de bonne foi, les employeurs sont tout aussi en droit de s\u2019interroger sur la \u00ab\u202fbanalisation\u202f\u00bb de l\u2019absent\u00e9isme depuis la crise du Covid. Pourquoi a-t-il <strong>cru de 18% dans son ensemble entre 2019 et 2023<\/strong> (avec des premi\u00e8res indications montrant une nouvelle hausse suppl\u00e9mentaire tangible en 2024) ? Pourquoi est-il, selon une enqu\u00eate r\u00e9alis\u00e9e par l\u2019UEL dans les entreprises en 2024, <strong>trois fois plus \u00e9lev\u00e9 le lundi et deux fois plus \u00e9lev\u00e9 le vendredi<\/strong> que les autres jours de la semaine\u202f? Pourquoi augmente-il avec la taille des entreprises\u202f?\u00a0<\/span><span data-ccp-props=\"{&quot;335551550&quot;:6,&quot;335551620&quot;:6}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Loin de placer sous \u00ab\u202fsoup\u00e7on g\u00e9n\u00e9ralis\u00e9\u202f\u00bb l\u2019ensemble des salari\u00e9s, les employeurs souhaitent mieux comprendre et appr\u00e9hender l\u2019absent\u00e9isme, <strong>l\u2019objectiver et disposer d\u2019outils plus efficaces pour y rem\u00e9dier<\/strong>. Tant <\/span><span data-contrast=\"auto\">pour les entreprises que pour les salari\u00e9s engag\u00e9s qui supportent une charge de travail et un stress accru et qu\u2019il convient de prot\u00e9ger, <\/span><strong>il<\/strong><span data-contrast=\"auto\"><strong> est primordial d\u2019apporter un \u00e9clairage approfondi sur ce ph\u00e9nom\u00e8ne<\/strong>. <\/span><span data-ccp-props=\"{&quot;335551550&quot;:6,&quot;335551620&quot;:6}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Aujourd\u2019hui, les employeurs n\u2019ont pas beaucoup d\u2019outils \u00e0 leur disposition et doivent subir de plein fouet l\u2019absent\u00e9isme rampant. \u00c0 l\u2019exception du \u00ab contr\u00f4le administratif \u00bb occasionnellement r\u00e9alis\u00e9 par la Caisse nationale de Sant\u00e9 (CNS), o\u00f9 ses agents v\u00e9rifient si une personne en incapacit\u00e9 de travail est bien \u00e0 son domicile et respecte le r\u00e9gime des \u00ab sorties autoris\u00e9es\u202f\u00bb, les entreprises disposent de peu de leviers d\u2019action. Elles peuvent, \u00e0 leurs frais, solliciter un m\u00e9decin pour effectuer une contre-expertise m\u00e9dicale. Toutefois, en dehors de ces options, elles se retrouvent r\u00e9duites \u00e0 un r\u00f4le de spectatrices payantes, sans possibilit\u00e9 d\u2019intervention, tout en devant en assumer les cons\u00e9quences.<\/span><span data-ccp-props=\"{&quot;335551550&quot;:6,&quot;335551620&quot;:6}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">L\u2019accord de coalition constate \u00e0 juste titre que \u00ab\u202f<\/span><i><span data-contrast=\"auto\">l\u2019absent\u00e9isme a consid\u00e9rablement augment\u00e9\u202f<\/span><\/i><span data-contrast=\"auto\">\u00bb et annonce que le gouvernement \u00ab\u202f<\/span><i><span data-contrast=\"auto\">luttera contre toute forme d\u2019abus<\/span><\/i><span data-contrast=\"auto\">\u202f\u00bb en la mati\u00e8re.\u00a0 Et pour cause, il est primordial que la composante abusive, ce \u00ab\u202fc\u00f4t\u00e9 obscur\u202f\u00bb de l\u2019absent\u00e9isme soit identifi\u00e9 et ensuite combattu efficacement et que donc le ph\u00e9nom\u00e8ne de l\u2019absent\u00e9isme dans son ensemble soit objectiv\u00e9.\u00a0<\/span><span data-ccp-props=\"{&quot;335551550&quot;:6,&quot;335551620&quot;:6}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Pour ce faire, et avant m\u00eame d\u2019\u00e9voquer un ou des \u00e9ventuel(s) \u00ab jour(s) de carence\u202f\u00bb, il est imp\u00e9ratif d\u2019<strong>augmenter significativement les contr\u00f4les m\u00e9dicaux<\/strong> effectu\u00e9s sur les assur\u00e9s d\u00e9clar\u00e9s en incapacit\u00e9 de travail. Aujourd\u2019hui, le Contr\u00f4le m\u00e9dical de la s\u00e9curit\u00e9 sociale (CMSS) intervient notamment dans le cadre d\u2019arr\u00eats longs, voire tr\u00e8s longs. <strong>Le CMSS joue un r\u00f4le extr\u00eamement pr\u00e9cieux \u00e0 cet \u00e9gard et appara\u00eet comme v\u00e9ritable pilote de l\u2019ensemble du syst\u00e8me de s\u00e9curit\u00e9 sociale luxembourgeois. <\/strong><\/span><strong>\u00a0<\/strong><\/p>\n<p><span data-contrast=\"auto\">N\u00e9anmoins, ce sont avant tout <strong>les arr\u00eats courts et surtout leur d\u00e9multiplication<\/strong> qui d\u00e9sorganisent le plus nos entreprises, qui les mettent quotidiennement devant des d\u00e9fis insurmontables et qui perturbent les autres \u00e9quipes en place en entreprise. <\/span><span data-contrast=\"auto\">Pour les arr\u00eats de courte dur\u00e9e, il est quasiment impossible de mettre en \u0153uvre, m\u00eame de fa\u00e7on limit\u00e9e, le contr\u00f4le administratif. <\/span><span data-contrast=\"auto\">Par ailleurs, le certificat d\u2019incapacit\u00e9 de travail ne doit parvenir que le troisi\u00e8me jour \u00e0 l\u2019employeur, pouvant constituer une perte de temps pr\u00e9cieuse pour intervenir \u00ab\u202fau moment des faits\u202f\u00bb.\u00a0<\/span><span data-ccp-props=\"{&quot;335551550&quot;:6,&quot;335551620&quot;:6}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Les entreprises n\u2019ont donc qu\u2019\u00e0 subir. Cet absent\u00e9isme pour cause de maladie n\u2018est d\u2019ailleurs qu\u2019un d\u00e9fi parmi d\u2019autres\u202f: <strong>augmentation du nombre de cong\u00e9s l\u00e9gaux, ing\u00e9niosit\u00e9 en mati\u00e8re de nouveaux \u00ab\u202fcong\u00e9s sp\u00e9ciaux\u202f\u00bb, allongement, flexibilisation et g\u00e9n\u00e9rosit\u00e9 de tous types de cong\u00e9s destin\u00e9s notamment aux familles<\/strong>. Bien que chacun de ceux-ci, pris isol\u00e9ment, peuvent se justifier, leur cumul est devenu une v\u00e9ritable probl\u00e9matique pour chacune de nos entreprises. De mani\u00e8re plus g\u00e9n\u00e9rale, <\/span><span data-contrast=\"auto\">la diminution du temps de travail effectif des salari\u00e9s <strong>accentue la p\u00e9nurie de main-d\u2019\u0153uvre<\/strong>, alors m\u00eame que nos entreprises \u00e9prouvent des difficult\u00e9s \u00e0 disposer des ressources n\u00e9cessaires pour fonctionner sereinement. <\/span><strong>C\u2019est aussi ce ph\u00e9nom\u00e8ne qui contribue \u00e0 la baisse de rentabilit\u00e9 et la stagnation de la productivit\u00e9.<\/strong>[\/vc_column_text][image_with_animation image_url=\u00a0\u00bb21747&Prime; image_size=\u00a0\u00bbfull\u00a0\u00bb animation_type=\u00a0\u00bbentrance\u00a0\u00bb animation=\u00a0\u00bbNone\u00a0\u00bb animation_movement_type=\u00a0\u00bbtransform_y\u00a0\u00bb hover_animation=\u00a0\u00bbnone\u00a0\u00bb alignment=\u00a0\u00bb\u00a0\u00bb border_radius=\u00a0\u00bbnone\u00a0\u00bb box_shadow=\u00a0\u00bbnone\u00a0\u00bb image_loading=\u00a0\u00bbdefault\u00a0\u00bb max_width=\u00a0\u00bb100%\u00a0\u00bb max_width_mobile=\u00a0\u00bbdefault\u00a0\u00bb][divider line_type=\u00a0\u00bbNo Line\u00a0\u00bb][vc_column_text]<span data-contrast=\"auto\">En premier lieu, il est donc essentiel de pr\u00e9voir des <strong>contr\u00f4les m\u00e9dicaux effectu\u00e9s \u00e0 plus grande \u00e9chelle et de mani\u00e8re plus fr\u00e9quente<\/strong> dans le cadre des arr\u00eats plus courts et r\u00e9p\u00e9t\u00e9s. Dans une r\u00e9cente r\u00e9ponse \u00e0 une question parlementaire, la Ministre de la Sant\u00e9 et de la S\u00e9curit\u00e9 sociale estimait entre 10 et 14% les personnes contr\u00f4l\u00e9es et d\u00e9clar\u00e9es capables de travailler suite aux contr\u00f4les effectu\u00e9s par le CMSS. Entre une personne sur dix et une personne sur sept sont donc d\u00e9clar\u00e9es capables de travailler rien qu\u2019\u00e0 la suite d\u2019une visite m\u00e9dicale aupr\u00e8s du CMSS. Il y a sans doute au moins une proportion \u00e9gale de personnes qui, au vu d\u2019une simple convocation par le CMSS, retrouvent la voie du travail. Ceci montre qu\u2019il existe indubitablement une certaine proportion de certificats de complaisance et\/ou des situation de \u00ab\u202fcong\u00e9s\u202f\u00bb de maladie pris quelque peu trop \u00e0 la l\u00e9g\u00e8re.<\/span><span data-ccp-props=\"{&quot;335551550&quot;:6,&quot;335551620&quot;:6}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Les contr\u00f4les m\u00e9dicaux renforc\u00e9s constituent donc l\u2019outil de pr\u00e9dilection mais \u00e9galement celui qui est le plus objectif afin de lutter contre l\u2019absent\u00e9isme abusif ou tout au moins pris \u00e0 la l\u00e9g\u00e8re. A cette fin, <strong>il est primordial de renforcer structurellement le CMSS et lui permettre d\u2019adapter le nombre de m\u00e9decins-conseil<\/strong> parall\u00e8lement \u00e0 l\u2019\u00e9volution des certificats d\u2019incapacit\u00e9 de travail.\u00a0<\/span><span data-ccp-props=\"{&quot;335551550&quot;:6,&quot;335551620&quot;:6}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Outre cette mesure, il sera tout de m\u00eame important, notamment dans le cadre du Groupe de travail \u00ab\u202fAbsent\u00e9isme\u202f\u00bb r\u00e9cemment mis en place par la Ministre de la s\u00e9curit\u00e9 sociale et de la Sant\u00e9, d\u2019\u00e9voquer d\u2019autres pistes pouvant responsabiliser l\u2019ensemble des acteurs de la \u00ab\u202fcha\u00eene
