L\u2019UEL demande que le projet de loi n\u00b0 7864 en vue d&rsquo;introduire un dispositif relatif \u00e0 la protection contre le harc\u00e8lement moral \u00e0 l&rsquo;occasion des relations de travail soit retir\u00e9 de la proc\u00e9dure l\u00e9gislative.<\/strong><\/p>\n<p style=\"font-weight: 400;\">Force est de constater que l\u2019Union europ\u00e9enne multiplie les initiatives en faveur du dialogue social tant sur le plan europ\u00e9en que sur le plan national. Ainsi, la r\u00e9cente directive (UE) 2022\/2041 relative \u00e0 des salaires minimaux ad\u00e9quats dans l\u2019Union europ\u00e9enne propose notamment d\u2019\u00e9tablir un cadre aux fins de promouvoir des n\u00e9gociations collectives en vue de la fixation des salaires. Plus r\u00e9cemment encore, la Commission europ\u00e9enne a propos\u00e9 en janvier 2023 une recommandation du Conseil COM(2023)38 qui d\u00e9finit la mani\u00e8re dont les pays de l\u2019Union europ\u00e9enne peuvent renforcer davantage le dialogue social et la n\u00e9gociation collective au niveau national, ainsi qu\u2019une communication COM(2023)40 sur la promotion du dialogue social en Europe.<\/p>\n<p style=\"font-weight: 400;\">Au Luxembourg, alors que le mod\u00e8le social s\u2019inscrit historiquement dans une tradition de dialogue social, le Gouvernement et la Chambre des D\u00e9put\u00e9s en bafouent pourtant les fondements au niveau national dans le cadre d\u2019une proc\u00e9dure l\u00e9gislative en mati\u00e8re de protection contre le harc\u00e8lement moral dont rien ne semble pouvoir arr\u00eater la course. Il existe en effet au Luxembourg un accord interprofessionnel conclu le 25 juin 2009 entre partenaires sociaux qui traite du harc\u00e8lement et de la violence au travail qui a \u00e9t\u00e9 d\u00e9clar\u00e9 d\u2019obligation g\u00e9n\u00e9rale par voie de r\u00e8glement grand-ducal du 15 d\u00e9cembre 2009. Cet accord, bas\u00e9 sur un accord europ\u00e9en, d\u00e9finit le harc\u00e8lement et la violence au travail et pr\u00e9voit des mesures de pr\u00e9vention et de gestion des actes de harc\u00e8lement et de violence dans les entreprises.<\/p>\n<p style=\"font-weight: 400;\">Faisant compl\u00e8tement fi de cet accord interprofessionnel toujours en vigueur, le Gouvernement a d\u00e9pos\u00e9 en juillet 2021 un projet de loi relatif au harc\u00e8lement moral \u00e0 l\u2019occasion des relations de travail. Au-del\u00e0 du m\u00e9pris pour le dialogue social au Luxembourg, l\u2019UEL d\u00e9nonce l\u2019ins\u00e9curit\u00e9 juridique majeure \u00e0 laquelle seront confront\u00e9es les entreprises du fait de la coexistence simultan\u00e9e de deux r\u00e9gimes issus l\u2019un de la future loi, l\u2019autre de l\u2019accord interprofessionnel existant, et de leurs incoh\u00e9rences sur des sujets identiques (d\u00e9finition du harc\u00e8lement, mesures de pr\u00e9vention, mesures de gestion, proc\u00e9dures\u2026).<\/p>\n<p style=\"font-weight: 400;\">\u00c0 l\u2019instar de la Chambre de Commerce et de la Chambre des M\u00e9tiers qui l\u2019ont \u00e9galement demand\u00e9 \u00e0 deux reprises dans <a href=\"https:\/\/www.cc.lu\/toute-linformation\/avis-legislation\/detail\/modification-du-code-du-travail-protection-contre-le-harcelement-moral-au-travail?tx_ccavis_avis%5Bpage%5D=6&amp;cHash=972710c84624f4fad901666bea3ff966\" target=\"_blank\" rel=\"noopener\">leurs avis communs<\/a>, l\u2019UEL ne peut que r\u00e9it\u00e9rer sa demande au Gouvernement, et en particulier au Ministre du Travail, de l\u2019Emploi et de l\u2019\u00c9conomie sociale et solidaire en tant qu\u2019auteur du texte, de retirer le projet de loi n\u00b0 7864 de la proc\u00e9dure l\u00e9gislative. Il en va de la cr\u00e9dibilit\u00e9 du Gouvernement et de la Chambre des D\u00e9put\u00e9s quant \u00e0 leur volont\u00e9 de pr\u00e9server le dialogue social au Luxembourg et de le promouvoir \u00e0 l\u2019avenir.
