Il est essentiel de pr\u00e9server le dynamisme \u00e9conomique et l\u2019attractivit\u00e9 du pays par une organisation du travail flexible bas\u00e9e sur un mod\u00e8le annualis\u00e9 qui r\u00e9pond de mani\u00e8re efficace aux besoins fluctuants des entreprises et des salari\u00e9s.\u00a0<\/strong><\/p>\n<p><span data-contrast=\"auto\">Les temps changent et la l\u00e9gislation devrait logiquement suivre les nouvelles m\u0153urs. Or, force est de constater que cette \u00e9volution l\u00e9gislative n\u2019a pas toujours lieu, comme c\u2019est notamment le cas pour l\u2019organisation du travail. Face aux \u00e9volutions des relations de travail et des attentes dans les milieux professionnels, il est aujourd\u2019hui grand temps de s\u2019y atteler pour fournir aux employeurs et aux salari\u00e9s un cadre propice permettant de trouver des solutions personnalis\u00e9es en fonction des besoins de l\u2019entreprise et du salari\u00e9.<\/span><span data-ccp-props=\"{&quot;335551550&quot;:6,&quot;335551620&quot;:6}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">En effet, malgr\u00e9 les facteurs externes qui bouleversent le march\u00e9 du travail comme la digitalisation, la robotisation, la mondialisation ainsi que les changements d\u00e9mographiques, changements acc\u00e9l\u00e9r\u00e9s par la pand\u00e9mie de la COVID-19, la l\u00e9gislation relative <\/span><span data-contrast=\"auto\">\u00e0<\/span><span data-contrast=\"auto\"> l\u2019organisation du travail n\u2019a malheureusement pas suivi le mouvement, en l\u2019absence de r\u00e9forme majeure.<\/span><span data-ccp-props=\"{&quot;335551550&quot;:6,&quot;335551620&quot;:6}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Si, pour \u00eatre \u00ab\u202fmoderne\u202f\u00bb, la politique reconna\u00eet volontiers les besoins des salari\u00e9s de s\u2019absenter plus facilement de leur lieu du travail sous la banni\u00e8re d\u2019une \u00ab\u202fmeilleure conciliation entre la vie professionnelle et la vie priv\u00e9e\u202f\u00bb, elle m\u00e9conna\u00eet en revanche le besoin fondamental des employeurs de pouvoir organiser le travail le plus efficacement possible dans un environnement complexe et changeant.<\/span><span data-ccp-props=\"{&quot;335551550&quot;:6,&quot;335551620&quot;:6}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Par cons\u00e9quent, les employeurs se trouvent aujourd\u2019hui confront\u00e9s, en plus des 26 jours l\u00e9gaux de cong\u00e9 annuel et des 11 jours f\u00e9ri\u00e9s pr\u00e9vus par la loi,<\/span><span data-contrast=\"auto\"> \u00e0 une <\/span><span data-contrast=\"auto\">douzaine de cong\u00e9s sp\u00e9ciaux de plusieurs jours voire plusieurs mois (cong\u00e9-jeunesse, cong\u00e9 parental, cong\u00e9 pour raisons familiales, cong\u00e9 linguistique\u2026) et \u00e0 pr\u00e8s d\u2019une dizaine de cong\u00e9s extraordinaires d\u2019un \u00e0 10 jours chacun (d\u00e9m\u00e9nagement, mariage, naissance\u2026). Et la liste continue encore de s\u2019allonger puisqu\u2019un nouveau cong\u00e9 d\u2019aidant et un nouveau cong\u00e9 pour raison de force majeure sont en passe d\u2019\u00eatre adopt\u00e9s. A ces cong\u00e9s, il convient d\u2019ajouter d\u2019autres motifs d\u2019absence, en particulier ceux pour raisons de sant\u00e9 (incapacit\u00e9 de travail, reprise progressive du travail, reclassement\u2026).<\/span><span data-ccp-props=\"{&quot;335551550&quot;:6,&quot;335551620&quot;:6}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Si l\u2019introduction continue de motifs d\u2019absence divers et vari\u00e9s est certainement une opportunit\u00e9 pour les partis politiques de se profiler pour les prochaines <\/span><span data-contrast=\"auto\">\u00e9lections<\/span><span data-contrast=\"auto\">, cette popularit\u00e9 facilement gagn\u00e9e ne r\u00e9sout aucunement le probl\u00e8me fondamental de l\u2019organisation du travail comme moyen d\u2019attractivit\u00e9 de l\u2019\u00e9conomie nationale et du d\u00e9calage grandissant entre les attentes des employeurs et des salari\u00e9s et la flexibilit\u00e9 du syst\u00e8me.<\/span><span data-ccp-props=\"{&quot;335551550&quot;:6,&quot;335551620&quot;:6}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Dans un contexte de p\u00e9nurie de main-d\u2019\u0153uvre qui frappe le Luxembourg comme les pays limitrophes et toute l\u2019Europe, les entreprises, en plus de devoir souvent prendre en charge la r\u00e9mun\u00e9ration des salari\u00e9s absents, voient leurs activit\u00e9s chamboul\u00e9es par ces multiples absences et ne parviennent plus<\/span><span data-contrast=\"auto\"> \u00e0 recruter pour y faire face<\/span><span data-contrast=\"auto\">. Ainsi, le fonctionnement interne des entreprises est perturb\u00e9, ce qui impacte directement tous les salari\u00e9s, comme la charge de travail doit \u00eatre report\u00e9e sur les autres collaborateurs afin de garantir, autant que possible, la fourniture des biens et la prestation des services aux clients, c\u2019est-\u00e0-dire <\/span><span data-contrast=\"auto\">\u00e0 nous<\/span><span data-contrast=\"auto\"> tous.<\/span><span data-ccp-props=\"{&quot;335551550&quot;:6,&quot;335551620&quot;:6}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Cette h\u00e9morragie d\u2019absences se trouve maintenant corrobor\u00e9e par des discussions de plus en plus concr\u00e8tes de r\u00e9duction du temps de travail. Avec les <\/span><span data-contrast=\"auto\">\u00e9lections<\/span><span data-contrast=\"auto\"> qui approchent <\/span><span data-contrast=\"auto\">\u00e0 grand<\/span><span data-contrast=\"auto\">s pas, le contexte pr\u00e9\u00e9lectoral est certainement propice aux annonces d\u00e9magogiques, mais \u00e9galement aux r\u00e9flexions f\u00e9condes pour les ann\u00e9es \u00e0 venir.<\/span><span data-ccp-props=\"{&quot;335551550&quot;:6,&quot;335551620&quot;:6}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Sans entreprises, pas d\u2019emplois. Il est essentiel de pr\u00e9server le dynamisme \u00e9conomique et l\u2019attractivit\u00e9 du pays par une modernisation r\u00e9elle de la l\u00e9gislation sur l\u2019organisation du travail. Face \u00e0 une p\u00e9nurie de main d\u2019\u0153uvre toujours plus accrue, les entreprises sont oblig\u00e9es de se d\u00e9marquer pour rester attractives. Certains employeurs peuvent ponctuellement envisager de proposer des cong\u00e9s suppl\u00e9mentaires ou de r\u00e9duire le temps de travail hebdomadaire pour attirer des collaborateurs ou <\/span><span data-contrast=\"auto\">\u00e9viter un<\/span><span data-contrast=\"auto\"> d\u00e9part vers une autre entreprise ou vers la fonction publique. Mais d\u2019autres voies sont possibles et les employeurs doivent garder la libert\u00e9 de choisir entre les diff\u00e9rentes options qui s\u2019offrent \u00e0 eux suivant les ressources et les besoins respectifs de l\u2019entreprise et des salari\u00e9s. La r\u00e9mun\u00e9ration, l\u2019am\u00e9nagement des horaires, l\u2019octroi de formations, la mise en place du t\u00e9l\u00e9travail ou de bureaux satellites pr\u00e8s des fronti\u00e8res ou encore la culture d\u2019entreprise, les m\u00e9thodes collaboratives de travail et de mani\u00e8re g\u00e9n\u00e9rale, l\u2019am\u00e9lioration continue de la qualit\u00e9 de vie au travail sont autant d\u2019atouts que les employeurs peuvent choisir de mettre en avant pour se d\u00e9marquer. Une flexibilisation du cadre de l\u2019organisation du travail est incontournable dans ce contexte.
