Juli 2020 \u00fcber Ma\u00dfnahmen zur Bek\u00e4mpfung der Covid-19-Pandemie (<a href=\"https:\/\/legilux.public.lu\/eli\/etat\/leg\/loi\/2020\/07\/17\/a624\/consolide\/20220311\" target=\"_blank\" rel=\"noopener\">koordinierter Text<\/a> mit dokumentarischem Wert, der am 11. M\u00e4rz 2022 in Kraft trat), stellen sich in den Unternehmen immer h\u00e4ufiger Fragen zur Fortf\u00fchrung der Telearbeit au\u00dferhalb der Krise.<\/p>\n<p>Gem\u00e4\u00df dem <a href=\"https:\/\/www.uel.lu\/wp-content\/uploads\/2020\/10\/2020-10-20-teletravail-convention-ogbl-lcgb-uel.pdf\" target=\"_blank\" rel=\"noopener\">\u00dcbereinkommen<\/a> \u00fcber die rechtliche Regelung der Telearbeit, das am 20. Oktober 2020 zwischen den Sozialpartnern unterzeichnet und durch eine <a href=\"https:\/\/www.legilux.public.lu\/eli\/etat\/leg\/rgd\/2021\/01\/22\/a76\/jo\" target=\"_blank\" rel=\"noopener\">gro\u00dfherzogliche Verordnung<\/a> vom 22. Januar 2021 f\u00fcr allgemein verbindlich erkl\u00e4rt wurde, k\u00f6nnen die Unternehmen eine spezifische Regelung f\u00fcr die Telearbeit festlegen, die auf die besondere Situation des Unternehmens zugeschnitten ist. Wenn es eine Personaldelegation gibt, erfolgen die Einf\u00fchrung und die \u00c4nderung dieser spezifischen Telearbeitsregelung nach Information und Konsultation der Personaldelegation im Sinne von Artikel L. 414-1 des Code du travail oder im gegenseitigen Einvernehmen zwischen dem Arbeitgeber und der Personaldelegation in Unternehmen mit mindestens 150 Besch\u00e4ftigten im Sinne von Artikel L. 414-9 des Code du travail. Die entsprechenden gesetzlichen Bestimmungen wurden gerade vom Gesetzgeber ge\u00e4ndert, um diese L\u00f6sung im Code du travail zu verankern (vgl. <a href=\"https:\/\/www.chd.lu\/wps\/PA_RoleDesAffaires\/FTSByteServingServletImpl?path=CC85C8E7730AAACB2E4FB962BBCD3A749CA0878C3DD739E98F9C714934C0BCFC573438D9BF5902CB1FF0F913328B6130$C03D818909F760B4D3AD1E28A3168E42\" target=\"_blank\" rel=\"noopener\">Verabschiedung<\/a> des Gesetzentwurfs Nr. 7862 durch die Abgeordnetenkammer am 16-03-2022). Den Unternehmen wird empfohlen, die <a href=\"https:\/\/ces.public.lu\/content\/dam\/ces\/fr\/avis\/themes-europeens\/2020-teletravail.pdf\" target=\"_blank\" rel=\"noopener\">Stellungnahme<\/a> des CES vom 11. September 2020 zur Telearbeit in Luxemburg zu konsultieren, um mehr \u00fcber die Hintergr\u00fcnde zu erfahren, die zum Abschluss des oben genannten Abkommens vom 20.
